TERMS AND CONDITIONS APPLICABLE TO GUESTS
1. TOURIST RENTAL
1.1. The parties:
- Guest or User should be interpreted as the one who enjoys the accommodation service and, therefore, always a physical person. The Guest or User is obliged to pay the amounts accrued due to the use of the accommodation. Note that even when we refer to Guest as a single person, those cases in which there is more than one Guest are included.
- Owner. The legal owner of the property registered as a home for tourist purposes.
- Manager, also known as Mediterra Rentals. When the Owner of the home transfers its use to the Manager, so that it can in turn transfer its use as accommodation to the Guest, the Manager is the person who operates the home in the name and representation of the Owner.
Both the Owner and the Manager or Mediterra Rentals may be referred to as “We”.
1.2. Accommodation Reservation Agreement
By booking the accommodation, the parties involved agree to the transfer of use of the tourist accommodation for use and enjoyment during the agreed period.
All Terms and Conditions are accepted, along with the attached information and as well as any other written information made known to the Guest at any time.
2. RESERVATION POLICY AND CONDITIONS
2.1. Reservation Form
- The Guest must not be under 21 years of age.
- The Guest accepts the reservation conditions on behalf of all guests.
- The accommodation is reserved for the number of people declared on the reservation form. In the event that the total number of persons exceeds the accommodation capacity advertised by us, we reserve the right to refuse accommodation to undeclared persons or, if it is possible or appropriate to stay at the property, charging an additional fee. These guests must fill out the registration form.
It is recommended that in the event that overoccupancy is anticipated, we are notified in advance to seek a solution in accordance with these new circumstances.
- The person who makes the Reservation will be responsible for the actions and behavior of each person in the group. This person will also be responsible for obtaining permission before providing personal data.
2.2. Reservation deposit
- The reservation will only be fully guaranteed after receipt of the deposit that corresponds to 25% of the total value of the stay. The deposit will be refundable within the first 48 hours from confirmation of the reservation. After 48 hours, the deposit will not be refundable.
- If the reservation is made directly through Mediterra Rentals, the total amount of the reservation must be paid six weeks before the start of the stay. If the full amount of the reservation is not paid within the period indicated above, the reservation will be canceled and the deposit will be retained. We may not send a reminder to the Guest, so it is the Guest's responsibility to ensure that their stay is paid for according to the policy and conditions in this section.
- Arrival details and other relevant information about the accommodation will also be sent by email once the full amount of the reservation has been paid.
2.3. Security Deposit
- Once all the terms and conditions of this agreement have been accepted, the demand and provision of the deposit will be mandatory to guarantee the Guest's obligations.
- The amount of the deposit will depend on the accommodation chosen and will be paid through an online deposit. For this purpose, the guest will receive a form to complete. The insured amounts are not blocked or debited and will not affect the bank card limit.
- The amount deposited as a deposit will be fully returned after completing your stay. The return is conditional on the accommodation having been left in satisfactory condition and the terms and conditions of the contract having been met.
- Failure to provide the deposit may result in not being allowed to check in to the property upon arrival and may be a cause for termination of the agreement.
3. ACCOMMODATION
3.1. How to Register
Upon arrival, a digital check-in must be completed for all Guests over 16 years of age using the check-in scan app, available for free download in the app store for Android and IOS devices, or a QR code will be provided to register online.
The instructions are very intuitive and easy to follow. To do this, you must have available the identity documents of the people who are required to register (passports, DNI or identity card of the country of which you are a national), the downloaded application and internet access. Please note that each accommodation has internet service.
Failure to register in a timely manner may mean that you are registered as a “no-show” and that your stay is cancelled.
3.2. Making available
- The Accommodation is transferred for use exclusively for the agreed upon days.
- The Accommodation is delivered fully furnished and equipped in conditions of immediate use.
- We reserve the right to modify or withdraw services or facilities or any activity without prior notice when reasonably necessary due to repairs, maintenance, weather conditions and circumstances beyond our control.
3.3. Schedules
3.3.1. Check-in
Check-in is available at all our properties, between 10:00 a.m. and 8:00 p.m.
If you wish to check-in between hours not included in the previous point, this is from 8:00 p.m. to 10:00 a.m., you must consult Mediterra Rentals as it may affect check-in. A key collection fee may apply.
If you do not inform us of the exact time or, in any case, the approximate time of your arrival sufficiently in advance, access to your property may be delayed or may not be possible at all, as it may happen that no one is available at the time of your arrival.
3.3.2. Entrance
The accommodation will be available with full access from 3:00 pm on the day of arrival and must be vacated before 10:00 am on the day of departure.
If arrival occurs before 3:00 pm, you are allowed to digitally check in, collect keys, and leave suitcases at the reserved accommodation. In this case, if the property is already available, you may be granted full access and use of the accommodation always at the discretion of Mediterra Rentals or the Owners.
3.3.3. Exit
The Guest will have the right to occupy the accommodation until 10 am on the day indicated as the departure date, and will return the property and keys to Mediterra Rentals.
Any stay that extends beyond the departure time, without prior agreement between the parties, will be considered illegal occupation, granting Mediterra Rentals or the Owner the right to initiate any judicial and extrajudicial legal actions recognized by law.
3.4. During the stay
It is advisable that upon arrival or during the period of stay, the Guest notifies Mediterra Rentals of any problem or defect in the property. Once notified of a problem, Mediterra Rentals undertakes to seek a solution as soon as reasonably possible. Any complaint filed after you have vacated the property will be dismissed.
4. CANCELLATION POLICY, RESERVATION MODIFICATION AND REFUND
4.1. CANCELLATIONS
We have the right to reject or cancel any reservation if, after accepting it, we become aware of any fact or information of illegal activities. In this case, no amount will be returned to the Guest.
4.1.1. Reservation cancellations before the arrival date:
If it is the Owner or Manager who cancels, all payments made up to that date will be refunded, as long as the force majeure circumstances provided for in this agreement do not occur.
If, on the other hand, the Guest is the one who cancels, the amount to be refunded will depend on how far in advance it is made to the arrival date. If cancellation occurs within the first 48 hours of booking confirmation, the Guest will receive a 100% refund. For cancellations made up to 6 weeks before arrival date, the guest will receive a 75% refund. When cancellation occurs within 6 weeks prior to arrival date, no amount will be refunded to the Guest.
4.1.2. Reservation cancellations during the stay:
When the Owner or Mediterra Rentals cancels, the remaining nights will be refunded. When this cancellation is due to the Guest's failure to comply with our terms and conditions, no amount will be refundable.
In the event that the Guest decides to cancel, he will not have the right to be reimbursed with any amount.
4.2. RESERVATION MODIFICATIONS
Changes to the reservation may be considered before the arrival date. If a date change is necessary and can be made, an administrative fee of €30 will be charged.
5. RIGHTS AND OBLIGATIONS OF THE PARTIES
5.1. Rights of the Owner or Manager
- Receive the agreed price for the accommodation.
- Prohibit access to the home to Guests who do not pay the total amount of the reservation or intend to stay beyond the agreed time.
- Remove luggage from the home when the Guest breaches this agreement or does not leave the property within the agreed period. Furthermore, in those cases in which the Owner or the Manager incurs an expense due to the fault and/or negligence of the Guest, the Owner will have the right to demand the expenses derived from those efforts: changing the lock, storage of the equipment, additional expenses for extra cleaning, etc. It is agreed that such costs will be deducted from the security deposit.
5.2. Guest rights
- The availability and use of the accommodation, as well as the common areas of the establishment where the accommodation is located.
- Access to the services that the Owner or Manager of the home can offer, which may be subject to payment of the price if these are not included.
5.3. Obligations of the Owner or Manager
- Once the reservation conditions have been met, we undertake to accommodate the guest in the home selected in the reservation form for the agreed period of time.
- Provide information related to any regulations applicable to the service.
- Ensure that the accommodation is delivered to the guest clean and with all appliances, furniture and devices in good working order.
- Find resources to solve any incident or breakdown that occurs in the accommodation during the stay. The search for these resources does not imply a guaranteed solution.
- Compensate for damages and losses suffered by the Guest or their property if there is fault or negligence.
5.4. Guest Obligations
- Payment in full for the accommodation reservation according to the terms and conditions of this agreement.
- Provide Mediterra Rentals or the Owner of the property with the name of the Guest and the people staying with them.
-Deliver identity documents of all the Guests who will be staying in the accommodation, such number of Guests being restricted the maximum capacity of the accommodation.
- The conservation and maintenance of the accommodation. The Guest will be responsible for all damages caused to the structure of the property and/or its annexes, furniture and facilities when due to improper use.
- Respect the rules of operation and coexistence of the accommodation set out in Annex I.
- Observe the rules of safety, coexistence and hygiene.
- Leave the accommodation within the agreed period.
When a breach of the obligations and conditions of the agreement occurs, it gives rise to contractual liability with the obligation to compensate and repair for any damages caused to the Owner.
6. CAUSES FOR TERMINATION
- Over occupation. When reservations have been made in excess of the maximum occupancy and it is impossible to accommodate the entire group in the same accommodation.
- When the Guest commits any of the illegal and prohibited activities established in Annex I point 2 referred to as “illegal and prohibited activities”.
- When there is a breach of any of the accommodation rules in Annex I point 1, which is considered serious.
Termination of the contract for any of these reasons does not give rise to a refund. Additionally, the civil consequences of such failures carry liability for any damages caused by the Guest. The gravity of the facts is at the discretion of the Manager or in any case the Owner.
7. CASES OF FORCE MAJEURE
Neither the Manager nor the Owner accepts responsibility or agrees to pay any compensation when the execution or fulfillment of the contract is prevented or affected by circumstances that amount to force majeure.
Force majeure circumstances include any event that We could not have foreseen or avoided, even with due diligence. Such circumstances include destruction or damage to the accommodation which cannot reasonably be remedied to a satisfactory standard before the start of your holiday due to fire, flood, explosion, storm or other weather damage, theft, damage by criminal acts, riot or civil conflict, industrial action, natural or nuclear disaster, fire, adverse weather conditions, war or threat of war, actual terrorist activity or threat of terrorist activity, epidemic and all similar situations beyond the control of the Owner or the Manager.
8. CLAUSE OF SPECIAL MENTION TO ILLEGAL OCCUPATIONS
The transfer of the use of the home is made in response not to the permanent need of the Guest to occupy it as a habitual residence, but to live sporadically.
The person who makes the reservation declares that he or she has a home/habitual residence. In the event that there are more Guests, the Guest makes this declaration on their behalf.
Failure by the Guest to comply with the terms and conditions of this agreement will entitle Mediterra Rentals and/or the Owner to terminate the contract. If, faced with these events, the Guest does not leave the accommodation immediately or within the time determined by the Owner or Mediterra Rentals, an illegal occupation will ipso facto occur, granting the right to seek assistance from the authorities' agents to remove the Guest from the accommodation.
9. APPLICABLE LEGISLATION AND JURISDICTION
The parties submit to the Jurisdiction and Courts in the judicial district where the property is located, for any incidents that may arise in the interpretation or fulfillment of this contract, as this is the place where the property is located, in accordance with the provisions of the current Civil Procedure Law of Spain.
ANNEX I
- ACCOMMODATION RULES
- The guest must adhere to civic behavior in accordance with morality and good customs, respecting the general rules of coexistence.
- Keep the housing unit in good condition without damaging the elements in it.
- Comply with the internal regulations of the community of owners, for which purposes a copy will be provided to the guest. Likewise, we emphasize respect for the rest hours of the residents of the community of owners. Any activity that disturbs the normal coexistence of the community in which the accommodation is located, such as loud music, noise or parties, and that causes well-founded complaints from neighbors, will be grounds for the accommodation to be vacated immediately with no refund of the amount paid for the stay.
- Garbage must be removed once you leave the accommodation. If the home has a barbecue, it must be cleaned. If you do not remove the rubbish, or similarly leave the property in an excessively dirty state, as mentioned above, you will be charged an excessive cleaning fee €20 per hour, plus VAT, to be deducted from your security deposit.
- It is prohibited to organize parties
- Pets are not allowed in the Accommodation unless previously notified and authorized by Mediterra Rentals or the Owner. If permission is granted, the Guest will be responsible for the behavior and control of the pet. Any damage or the need for a deeper cleaning to remove muddy footprints and pet hair will result in the deduction of the deposit proportional to the amount allocated to repair the property or to hire the extra cleaning service.
- ILLEGAL AND PROHIBITED ACTIVITIES
It is prohibited to sublease the accommodation or use it for purposes other than those for which it was contracted.
Major or minor works that modify the structure or distribution of the rooms of the home are prohibited.
Inappropriate behavior that incites violence, threats or invasion of privacy exerted on any other guest or anyone who may interact with the Guest.
Production, preparation, cultivation and/or distribution of drugs and illegal substances, sexual exploitation of minors.
