TERMS AND CONDITIONS APPLICABLE TO GUESTS
Effective Date: February 17, 2025
1. TOURIST RENTAL
1.1. The Parties
- Guest or User: Refers to the individual who benefits from the accommodation service. The Guest or User is responsible for paying all amounts due for the use of the accommodation. When referring to "Guest" in singular form, it also applies to cases where multiple Guests are involved.
- Owner: The legal owner of the property registered as a home for tourist purposes.
- Manager (Mediterra Rentals): When the Owner transfers the use of the property to the Manager, the Manager is responsible for operating the property and making it available to the Guest in the Owner’s name and representation.
Both the Owner and Manager (Mediterra Rentals) may be referred to as "We."
1.2. Accommodation Reservation Agreement
By booking the accommodation, all parties involved agree to the temporary transfer of use of the tourist accommodation for the agreed period.
All Terms and Conditions, including any additional information provided in writing at any time before or during the stay, are considered accepted by the Guest.
2. RESERVATION POLICY AND CONDITIONS
2.1. Reservation Requirements
- The Guest must be at least 21 years old.
- The Guest accepts the reservation conditions on behalf of all accompanying guests.
- The accommodation is reserved only for the number of guests declared in the reservation form. If the actual number of guests exceeds the advertised capacity, we reserve the right to refuse accommodation to undeclared persons or charge an additional fee if their stay is permitted.
- Mandatory Guest Registry: In accordance with Spanish Royal Decree 933/2021, all Guests are required to complete a guest registry within 24 hours of booking. Failure to do so may result in cancellation of the reservation without a refund.
Guests must notify us in advance if over-occupancy is anticipated so that an appropriate solution can be arranged.
- The person making the reservation is responsible for the behavior and compliance of all members of the group and must obtain their consent before providing personal data.
2.2. Reservation Deposit
- The reservation is only fully guaranteed after the deposit payment of 25% of the total stay.
- The deposit is refundable within 48 hours after booking confirmation. After this period, the deposit becomes non-refundable.
- If the reservation is made directly through Mediterra Rentals, the total amount must be paid in full six weeks before arrival. Failure to complete payment will result in cancellation, with the deposit retained. No additional reminder will be sent.
- Arrival details and accommodation information will be sent after full payment has been received.
2.3. Security Deposit
- A security deposit is mandatory to cover any potential damages or contract violations.
- The deposit amount varies by property and is paid via online deposit through a secure form. This process does not block or deduct funds from the Guest’s bank account.
- The deposit is fully refunded after check-out if the accommodation is returned in satisfactory condition and all terms have been met.
- Failure to provide the deposit may result in the denial of check-in and termination of the agreement.
3. ACCOMMODATION
3.1. Check-In Process
Upon arrival, a digital check-in is required for all Guests over 16 years old via a dedicated check-in scan app (available on Android and iOS) or through an online QR registration.
Failure to complete check-in may result in cancellation of the reservation and be marked as a "no-show."
3.2. Property Use and Availability
- The accommodation is transferred for use only during the agreed-upon dates.
- The property is provided fully furnished and equipped for immediate use.
- We reserve the right to modify or withdraw services, facilities, or activities without prior notice if necessary for repairs, maintenance, weather conditions, or unforeseen circumstances.
3.3. Check-In and Check-Out Times
3.3.1. Check-In
- Check-in is available between 10:00 a.m. and 8:00 p.m.
- Late check-in between 8:00 p.m. and 10:00 a.m. must be requested in advance, and a key collection fee may apply.
- If no exact or approximate arrival time is provided in advance, access to the accommodation may be delayed or denied.
3.3.2. Access to the Accommodation
- The accommodation is fully available from 4:00 p.m. on the day of arrival and must be vacated by 11:00 a.m. on the day of departure.
- Unauthorized late check-out will result in a penalty equal to the full nightly rate applicable to the departure date (excluding any discounts).
3.3.3. Check-Out
- Guests must vacate the accommodation by 11:00 a.m. on the departure date and return all keys to Mediterra Rentals.
- Late departures without prior agreement will be considered illegal occupation, and legal action may be taken.
3.4. During the Stay
- Guests should report any issues or defects in the property immediately.
- Mediterra Rentals will work to resolve reported issues as soon as reasonably possible.
- Complaints made after check-out will not be considered.
3.5. Lost and Found Policy
- Mediterra Rentals is not responsible for any personal belongings left behind by Guests.
- Items left by Guests will be returned solely at the discretion of Mediterra Rentals.
- Any items deemed suitable for return will be sent at a time and by a method convenient to Mediterra Rentals.
- Guests are responsible for any shipping and handling costs incurred in returning lost items.
4. CANCELLATION POLICY, MODIFICATIONS, AND REFUNDS
4.1. Cancellations
We reserve the right to cancel any reservation if we become aware of any illegal activities, in which case no refund will be issued.
4.1.1. Cancellation Before Arrival
- If cancellation is made by the Owner or Manager, all payments will be refunded unless force majeure circumstances apply.
- If the Guest cancels, refunds are as follows:
- 100% refund if canceled within 48 hours of booking confirmation.
- 75% refund if canceled up to 6 weeks before arrival.
- No refund if canceled within 6 weeks of arrival.
4.1.2. Cancellation During Stay
- If the Owner or Mediterra Rentals cancels, unused nights will be refunded.
- If the cancellation is due to the Guest’s breach of terms, no refund will be given.
- Guests who choose to leave early are not entitled to any refund.
4.2. Reservation Modifications
- Changes to reservations may be considered before arrival.
- A €30 administrative fee applies for date changes.
5. RIGHTS AND OBLIGATIONS
5.1. Rights of the Owner or Manager
- Receive full payment for the accommodation.
- Deny access to guests who fail to pay in full or attempt to stay beyond the agreed time.
- Remove unauthorized luggage and belongings from the property.
5.2. Guest Rights
- Full access to the accommodation and common areas.
- Use of additional services, which may be subject to extra charges.
5.3. Guest Obligations
- Ensure full payment according to this agreement.
- Provide accurate guest details and identification documents.
- Maintain the property in good condition and report any damages.
- Comply with community rules, noise restrictions, and waste disposal guidelines.
- Vacate the accommodation within the agreed period.
Failure to comply may result in financial penalties or termination of the agreement.
6. FORCE MAJEURE
Neither the Owner nor Manager is responsible for contract disruptions due to unforeseen circumstances such as natural disasters, war, pandemics, or other uncontrollable events.
7. APPLICABLE LAW AND JURISDICTION
This contract is governed by Spanish law, and any disputes shall be handled by the courts of Málaga.
